RGM clears record of career service law enforcement officer

A career service law enforcement officer on promotional probation was terminated as a result an internal investigation regarding allegations that the officer had defrauded the State of Florida. His global profile sheet showed that he had been terminated for the commission of a crime and that he lacked good moral character. The Criminal Justice Standards & Training Commission (“CJSTC”) initiated a separate proceeding to revoke his law enforcement license. His lawyer at the time told him that nothing could be done. RGM partner Alejandro Garcia appealed the officer’s dismissal to the Public Employees Relations Committee (“PERC”). The agency settled with the officer immediately, vacated the termination, and cleared his global profile sheet. The CJSTC, however, refused to dismiss the charge against his license and held a preliminary hearing to determine whether there was “probable cause” to proceed with the charge. Ultimately, the panel did not enter a finding of probable cause and the officer left the hearing with his license. The officer was immediately hired by a new law enforcement agency.
